Terms of Service

A Hosting Terms of Service (ToS) agreement is a legally binding document that outlines the rules, responsibilities, and expectations that apply to all customers of a hosting provider. These terms typically cover matters such as acceptable use policies, resource usage limitations, payment terms, data privacy, and dispute resolution procedures. It is essential for both the hosting provider and customers to adhere to these terms to ensure a secure and mutually beneficial hosting relationship.

The Services Agreement (referred to as the ‘Agreement’) outlined herein encompasses the comprehensive terms and conditions governing your utilization of web hosting, domain registrations, e-commerce, dedicated servers, and various other services offered by STAXIZ (referred to as the ‘Services’). Within this Agreement, the terms STAXIZ, ‘we,’ and ‘us’ pertain to STAXIZ, while the terms ‘Client,’ ‘you,’ and ‘your’ refer to YOU, the user. By procuring any of our hosting packages, you are acknowledging that you have thoroughly reviewed this Agreement and are in agreement with its terms, conditions, and all associated policies. Non-compliance with these terms and conditions may lead to the suspension or termination of your account, a decision that rests solely with the Hoster and is determined on a case-by-case basis. Furthermore, our Acceptable Use Policies provide additional detailed guidance on what constitutes acceptable use of our products and services. Please be aware that accounts may be terminated if they are found to be in violation of our terms and conditions as outlined below, such as when customers lack knowledge or experience with basic web principles. STAXIZ extends hosting services to clients worldwide and bears the responsibility to safeguard each client while delivering the highest-quality services available. All clients registered with STAXIZ must acknowledge and adhere to our Privacy Policy and the following Terms of Service: Clients recognize that the nature of the services provided may result in interruptions for various reasons beyond STAXIZ‘s control, and damages arising from such interruptions are difficult to quantify. As such, clients agree that STAXIZ cannot be held liable for damages stemming from causes beyond STAXIZ‘s direct and exclusive control. Furthermore, subscribers acknowledge that STAXIZ‘s liability for its own negligence shall not exceed the total charges paid by the subscriber for services during the period when the damages occurred. STAXIZ shall not, under any circumstances, be held responsible for any special or consequential damages, losses, or injuries.

Indemnification Policy

1.1     You agree to use all STAXIZ services and facilities at your own risk. STAXIZ specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall STAXIZ be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential, or other damages. Clients agree that they shall defend, indemnify, save and hold STAXIZ harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees asserted against STAXIZ, its agents, its customers, officers, and employees, that may arise or result from any service provided, performed, agreed to be performed, or any product sold by its customers, its agents, employees, or assigns. Clients agree to defend, indemnify, and hold harmless STAXIZ against liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with STAXIZ’s network. 1.2    STAXIZ reserves the right to intervene with any website/data hosted on its servers/network in the interest of its clients. Any material supplied/hosted by a client that is infringing or allegedly infringing on the proprietary rights of a third-party copyright owner is subject to removal from STAXIZ’s servers/network. STAXIZ shall be the sole judge of what violates this policy. 1.3     Age Restriction: You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of, or access to the Services by anyone under eighteen (18) is unauthorized and is a violation of this Agreement. 1.4    Third Party: If you use the Services on behalf of another party, you agree that you are authorized to bind such other party to this Agreement and to act on such other party’s behalf with respect to any actions you take in connection with the Services. 1.5     Contact Information: It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address that is different from the domain you are signing up under. If there is ever an abuse issue or we need to contact you, we will use the primary email address we have on file. It is your responsibility to ensure that the contact information for your account, including any domain accounts, is accurate, correct, and complete at all times. This information may be verified by us at any time by asking for a copy of your National Identity Card or calling you on your phone number. We are not responsible for any lapse in the Services, including without limitation, any lapsed domain registrations due to outdated contact information being associated with the domain. If you need to verify or change your contact information, please contact our team via email or update your contact information through our support system. Providing false contact information of any kind may result in the termination of your account. For dedicated server purchases or in certain other cases, you may be required to provide government-issued identification and possibly a scan of the credit card used for verification purposes. Failure to provide the information requested may result in your order being denied. 1.6     Account Security: You agree to be fully responsible for all use of your account and for any actions that take place through your account. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account. It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of the installation method. When at all possible, set permissions on most directories to as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. You are required to use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change or update your password before suspending your account.

Invoice & Billing

2.1     It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, at our sole discretion, payments may be applied to outstanding invoices in your billing account.

2.2     At this time, we bill monthly, quarterly, semi-annually and annually, depending upon the plan. We provide a 7-day money-back (refund) guarantee if we wouldn’t provide you services which we promised for. Each refund request must be submitted using our support ticket system. Each refund request is evaluated on a case by case basis – depending on the situation, no refund, full refund or partial refund will be issued. If a refund is not issued, an account credit may be issued. STAXIZ will only issue a refund or credit within 7 days after the initial sign up date of the service. Therefore, STAXIZ retains the right to grant or deny any refund or credit request – not affected by date. (For some special offers, the money-back guarantee day will be varied; Domain Name registration/transfer fee(s) are non-refundable. Crypto Currency payments are non-refundable but may receive an account credit. To prevent abuse, only a client’s first invoice is eligible for a refund unless stated otherwise.

2.3     We accept payment methods such as IBFT, JazzCash, EasyPaisa, and cryptocurrency. All our services are set up without any additional fees or charges. We especially encourage overseas clients to make payments using cryptocurrency, specifically USDT (Tether) or BTC, as it currently offers the most straightforward payment process. It’s important to note that our services do not have fixed contract periods, and your contract will be automatically renewed for each successive period unless we receive notification to the contrary.

2.4     Domain and Hosting Registration and Renewal: Registration or renewal of these services will only be initiated upon receipt of payment. Please understand that no exceptions will be made regarding payment, so we kindly request that you refrain from requesting any special considerations in this matter. We treat these processes as professional transactions and appreciate your understanding in maintaining a positive approach to this policy.

2.5     Upgrading Your Hosting Plan: Should you wish to upgrade your hosting plan, we will only bill you for the difference between your current plan and the new plan you select. It’s important to note that in this scenario, your current plan’s expiry date will remain unchanged.

2.6     Downgrading Your Hosting Plan: We do not provide the option to downgrade your hosting plan. However, if you require a lower-tier plan, we recommend signing up for the desired plan separately from the beginning.

2.7     Renewal Policies: When it comes to renewing your domain, please visit our Domain Registration page to find the applicable fees. It’s important to note that hosting renewals are priced differently than the initial sign-up, and these renewal prices are specified separately, often with discounts applied.

2.8     Change in Prices: STAXIZ retains the discretion to modify prices, currency, the monthly payment amount, or any associated fees at any given time. Please be aware that payments made in currencies other than the US Dollar, such as Pakistani Rupees, are linked to the US Dollar and may vary with fluctuations in foreign exchange rates. It is your sole responsibility to regularly review the billing information furnished by us or communicated through other means, which includes notifications disseminated or posted by us.

2.9     Government Taxes: The fees listed for our services do not encompass any relevant sales, use, revenue, excise, or other taxes that may be imposed by taxing authorities, notably Federal and Provincial Sales Tax, unless specified otherwise. Any applicable taxes will be itemized separately on your invoice and are your responsibility to settle. If these taxes are not included in your invoice, it remains your obligation to ensure they are paid. By accepting this agreement, you confirm your agreement to cover all Sales Tax expenses if you have not remitted them to STAXIZ. It’s essential to note that all fees are considered non-refundable once payment has been made, unless expressly indicated otherwise.

2.10     Late Payment or Non-Payment: Any outstanding invoice may lead to the suspension or termination of all services associated with your account. Access to the account will only be reinstated upon receipt of payment. In the event that you do not fulfill the specified fee obligations, we reserve the right to suspend or terminate your account(s) and initiate the collection of costs incurred by STAXIZ, which may include arbitration and legal fees, as well as attorney fees. Please be aware that we will not activate new orders or new packages for customers who have an outstanding balance on their account.

2.11    Hosting Renewal After Expiry: To renew your hosting, you can do so by remitting the renewal charges detailed in your invoice. However, if more than 30 days have elapsed since the hosting’s expiration, you will be required to pay an additional Rs. 1000 for every subsequent 30-day period following the initial 30 days. Approximately two years’ worth of data will be accessible upon request. Our backup service has been in operation since January 2022, ensuring data availability within this time frame.

2.12    Domain Renewal Before or After Expiry:

Scenario 1 – Before Expiry > To avoid redemption or auction charges, please make sure to renew your domain before its expiry date. Our practice includes sending you email reminders approximately 29, 10, and 3 days before the domain’s expiry. Additionally, we use WhatsApp to remind you to renew your domain. Scenario 2 – After Expiry > If you do not renew your registration before it expires:

From days 1 to 30* after expiration, your domain name will be placed on hold (Grace Period), meaning that viewers will no longer be able to get to your website. There is no additional fee to renew during this time period. Renewals will be charged at the standard rate. See the list of supported TLDs and prices to determine the standard rate for renewing your domain.

From days 31 to 60* after expiration, your domain name will be prepared for deletion. You may still be able to restore your domain name, but there will be an additional fee to restore it, thats we call Redemption Charges. The restoration fee is set by the registry. Each top-level domain (TLDs) or domain endings will have its own fee. Say is normal Domain renewal charges is $13 then it would be $13×10=$130 excluding the renewal $13.

61 days* after expiration, If you still haven’t renew your Domain then your domain will soon be deleted, and then available for others to buy at normal price or worst scenario if it’s available through Auction price which might be over $1000 in most cases.

Uptime & Server related Queries

3.1    STAXIZ offers each client with a 99.9% uptime guarantee. In the event that a 99.9% uptime (measured per month) is not met, clients will be eligible to receive a credit(s) based on the situation and amount of downtime. However credit(s) may not be provided for certain events such as: DDoS (Distributed Denial of Service) attacks, scheduled maintenance, reboots, hardware replacements and null-routes. In order to receive a “compensation” credit, the client must do so by making a request by opening a billing ticket or by emailing support.

3.2    STAXIZ’s network is DDoS (Distributed Denial of Service) protected, we cannot guarantee any level/type of protection. We are often able to protect against various types of attacks up to 20Gbps. Attacks that are larger than this will result in the target IP address being null-routed. We are not responsible for any downtime or performance decreases caused by DDoS attacks.

3.3     404 Error Page: In the event you fail to configure a 404 error page, a default 404 error page will be configured by STAXIZ to appear in the event an Internet user enters a URL related to your domain but for which no file is associated. By not configuring a 404 error page, you hereby consent to and authorize STAXIZ’s placement of a default 404 error page and its associated content on your website. STAXIZ’s 404 error page may contain advertisements and other materials selected by STAXIZ in the STAXIZ’s sole discretion. This may include, but is not limited to, third-party websites, third-party product and service offerings, and/or Internet search engines. You may change the 404 error page configuration at any time. STAXIZ reserves the right to collect and retain all revenue obtained from such advertising and other materials.

3.4     Third Party Services: STAXIZ does not make any representations or warranties regarding, and is not liable for, the quality, availability, or timeliness of goods or services provided by a third party provider. You undertake all transactions with these third party providers at your own risk. We do not warrant the accuracy or completeness of any information regarding third party providers. STAXIZ is not an agent, representative, trustee or fiduciary of you or the third party provider in any transaction.

3.5     Resold Products: We may act as a reseller or sub licensor of certain third party services, hardware, software and equipment used in connection with the Services (“Resold Products”). We shall not be responsible for any changes in the Services that cause any Resold Products to become obsolete, require modification or alteration, or otherwise affect the performance of the Services. Any malfunction or manufacturer’s defects of Resold Products, either sold, sublicensed or provided by us to you will not be deemed a breach of STAXIZ’s obligations under this Agreement. Any rights or remedies you may have regarding the ownership, licensing, performance or compliance of any Resold Product are limited to those rights extended to you by the manufacturer of such Resold Product. You are entitled to use any Resold Product supplied by us only in connection with your use of the Services as permitted under this Agreement. You shall make no attempt to copy, alter, reverse engineer, or tamper with such Resold Product or to use it other than in connection with the Services. You shall not resell, transfer, export or re-export any Resold Product, or any technical data derived therefrom, in violation of any applicable law, rules or regulations.

3.6     Data Center: We reserve the right to migrate your account from one data-center to another in order to comply with applicable data center policies, local law or for technical or other reasons without notice.

3.7    Account Suspension: Continuous overuse of server resources may also result in account suspension/termination. Any account using 25% CPU / Memory resources for more than 60 seconds, resulting from the single or combined use of FTP, CGI Scripts, HTML or MySql resources will result in account suspension.

3.8    Provision of the Services: You agree to cooperate fully with us in connection with our provision of the Services. It is solely your responsibility to provide any equipment or software that may be necessary for your use of the Services. To the extent that the performance of any of our obligations under this Agreement may depend upon your performance of your obligations, STAXIZ is not responsible for any delays due to your failure to timely perform your obligations.You are solely responsible for ensuring that all User Content and User Websites are compatible with the hardware and software used by us to provide the Services, which may be changed by us from time to time in our sole discretion.

3.9     Data Loss Issue: You are solely responsible for backing-up all User Content, including but not limited to, any User Websites. STAXIZ does not warrant that we back-up any User Content, and you agree to accept the risk of loss of any and all User Content.

3.10    Website / cPanel / Webmail not working issue: Incase of three invalid login on cpanel or webmail by a client or any other person, we block their IP address so website not remain present on their IP address as well as CPanel and Webmail become invalid, but from other IP address website and other services running fine. So whenever this happen with you, contact us and let us know your IP address so we unblock them. To find out your current IP address visit: www.catchmyip.com

3.11     Email Issues on Shared Hosting: If your website is hosted on a shared server, you may encounter occasional email-related challenges. An email server on a shared hosting environment can experience overloads due to the need to establish outgoing connections for each email message. When the email server is inundated with requests to send emails, these emails are placed in a queue and sent out one by one. An overloaded server with numerous mail requests can lead to delays in email delivery and may result in error messages like “Domain xyz.com.pk has exceeded the maximum deferrals and failures per hour (5/5 (75%)) allowed. Message discarded.” This occurs because the mail server attempts to send an email five times to a specific email address and encounters difficulties, possibly due to reasons such as Outlook settings, a full recipient mailbox, or other issues on the recipient’s side. In such cases, it’s advisable to wait for an hour and then attempt to manually send the email to that address for confirmation.

For our Shared Hosting accounts, there is a maximum hourly email limit of 100. If your email is in the queue, you will need to wait for its delivery. If someone is sending a large number of emails in a short period, it may occasionally result in bounced emails due to server load. However, this limit is lifted for VPS and Dedicated Hosting accounts, allowing domains on those accounts to send an unlimited number of emails per hour.

Occasionally, a spammer may exploit a vulnerability on the server, leading to the mass sending of spam emails and overloading the mail server. In such cases, our server may block the sending of emails through a particular email or cPanel account to address the spamming issue. We recommend considering the purchase of ‘GSuite’ for your email needs. GSuite enables you to send professional emails from your business web address (you@example.com) and create group mailing lists, such as sales@example.com.

3.12    Disk Space Abuse  (For unlimited Hosting & Bandwidth clients): The space we provide for hosting should not be used as a storage medium for your files or data. At least 90% of your web pages must be ‘linked’ with files (GIF, JPEG, etc.) stored on Host servers. Website that are found to contain either/or no HTML documents, a large number of unlinked files or videos over 30MB are subject to files deletion or account cancelation. As well as Unlimited Hosting Accounts are also bound with fair use policy which include 10GB – 20GB as per the Package.

3.13    Account Resources Abuse: Continuous overuse of server resources may also result in account suspension / termination. Any account using 25% CPU / Memory resources for more than 60 seconds, resulting from the single or combined use of FTP, CGI Scripts, HTML or MySql resources will result in account suspension.

3.14   Technical Support Boundaries: STAXIZ provides technical support for you that encompasses within our area of expertise only. Such expertise includes assistance, installation, troubleshooting, and debugging, and any other hosting related issues. However, in under no circumstances is STAXIZ neither obligated to help you in providing assistance for any coding related issues, errors produced by any applications.

3.15   Backups and Data Loss: You use our services on your own sole risk. STAXIZ is not responsible for files, data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate local backups of files and data stored on our servers.

STAXIZ only provide you services which not covered any support in terms of build a website, email linking or any other things which related to hosting or domain redirection.

3.16   Limitation of Liability: STAXIZ shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from STAXIZ servers going off-line or being unavailable for any reason whatsoever. Furthermore, STAXIZ shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of STAXIZ servers. All damages shall be limited to the immediate termination of service.

Disclaimer

4.1     STAXIZ cannot be held liable for system downtime, crashes, or data loss. STAXIZ has the right to terminate, suspend or cancel any client and or any service without notice or refund. We cannot be held liable for any predicted estimate of profits/income in which a client would have gained if their service was functioning. Certain services provided by STAXIZ are resold. Thus, certain equipment, routing, software, and programming used by STAXIZ are not directly owned or written by STAXIZ. Moreover, STAXIZ holds no responsibility for the use of our clients’ accounts. If any of our terms, policies or conditions are failed to be followed, the client account in question may be deactivated as well as all services/products attached to it. We reserve the right to remove any account without advance notice for any reason without restitution as STAXIZ sees fit. STAXIZ is not responsible for any clients files, data or actions. FURTHERMORE, STAXIZ retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

4.2     Expired Domain : STAXIZ is not responsible if client/customer didn’t renew its Domain before the expiry or it was delayed due to non-payment of invoice from client/customer end. Our client-area portal generates an auto email which informs client/customer that your Domain is about to expire and it’s renewal price.

Domain availability chances:  If client/customer do not renew the domain name  during the registry grace period, it will be placed on Redemption period. Your domain can enter redemption about 45 days after it expires. Domain in redemption requires a special redemption fee in addition to the regular domain renewal fee. If still client/customer didn’t renew it then it will move to Pending Delete Period which would be lasts approximately 5 days then domain cannot be redeemed, wait for the pending status to be deleted. If the original owner or the registrar doesn’t buy the domain, it will be deleted and released for general registration.

In some cases someone else bought it and placed it on Auction, then it would be hard to get it back as it may cost a lot as compared to Redemption price.

4.3      Expired Hosting: STAXIZ holds no responsibility if a client/customer fails to renew their hosting before its expiration or if the renewal is delayed due to non-payment of invoices on the client/customer’s part. Our client-area portal automatically generates email notifications to inform clients/customers about the impending expiration of their hosting and the associated renewal pricing. If anyone wishes to retrieve their hosting data after expiration, it is imperative to renew their hosting plan, as detailed in section 2.11 for more information.

4.4   Addon Domain Responsibility: Customers are responsible for the setup and management of addon domains on their hosting accounts. This includes configuring website files, databases, email accounts, and any associated settings.

Technical Support Scope: STAXIZ provides technical support for issues related to server infrastructure, service uptime, and general server-side configurations. We do not offer support for specific issues related to individual addon domains, including but not limited to:

a. Website design and coding problems.

b. Software and script compatibility issues.

c. Third-party application or plugin errors.

d. Content management system (CMS) customization and troubleshooting.

e. Email client configuration or troubleshooting for addon domain email accounts.

Self-Service Resources: We encourage customers to utilize available self-help resources, such as knowledge base articles, user guides, and community forums, to address addon domain-specific issues.

Third-Party Support: For issues related to third-party applications, plugins, or scripts used on addon domains, customers should seek support directly from the respective software developers or communities.

Escalation of Issues: In rare cases where an issue is determined to be server-related but affects addon domains, we will investigate and resolve the issue to the best of our ability. However, the primary responsibility for troubleshooting and maintaining addon domains rests with the customer.

Compliance with Terms of Service: Customers are expected to adhere to STAXIZ‘s Terms of Service and Acceptable Use Policy when configuring and managing addon domains. Violations may result in account suspension or termination.

Acceptable use Policy (AUP)

5.1     This Acceptable Use Policy governs your use of the Services and is incorporated by reference into our Terms of Service. Unless otherwise stated, defined terms in this AUP have the meanings provided to them in the Terms of Service. We may modify this AUP at any time without notice.

5.2     You shall use the Services only for lawful purposes. Transmission, storage, or display of any information, data, or material in violation of applicable laws or regulations, especially of the laws of Pakistan, is prohibited. We reserve the right to terminate the Services for any Customer that exposes the Company to legal liability or threatens its ability to provide services to other customers. You agree to indemnify and hold the Company harmless from any claims resulting from your use of the Services.

5.3     No Illegal or Harmful Use – You may not use the Services to publish content or engage in activity that is harmful to others or illegal under applicable law, including without limitation in connection with any of the following illegal, harmful or fraudulent activities:

  • Disclosing private sensitive personal information about others.
  • Distributing malware or other malicious code.
  • Engaging in the unlawful distribution of controlled substances and drug contraband.
  • Engaging in the unlawful distribution of prescription medications, including, but not limited to, promotion, marketing, or sale of prescription medications without a valid prescription.
  • Gambling content not allowed also.
  • Hosting pornography or content that is potentially pornographic (Any website found to be hosting pornography or linking to pornography will be suspended immediately without notice and reported to law enforcement.
  • Hosting FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme, High-Yield Interest Programs (HYIP) or related sites.
  • Hosting or linking to a website intended to deceive the public including, but not limited to sites listed at orgescrow-fraud.com.
  • Hosting or linking to an anonymous proxy server.
  • Infringing upon the Intellectual Property Rights of Others. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software/warez, or any other copyrighted work.
  • Money laundering.
  • Any material that is against Islamic or any other Religion.
  • Any politically inciteful material as determined by the Pakistan Penal Code.
  • Any material that causes racism, sexism or divisions in society.
  • Phishing or engaging in identity theft; and Selling weapons or ammunition.

5.4     No Unauthorized System Access or Network Abuse – You may not use the Services to gain access into any network or system without permission. Prohibited activities include:

  • Accessing another network without permission, to probe or scan for vulnerabilities or breach security or authentication measures.
  • Attacking other networks (i.e. Denial of Service (DoS) attacks).
  • Intercepting or monitoring data without permission.
  • Running a file sharing site.
  • Running any software that interfaces with an IRC (Internet Relay Chat) network.
  • Using any deep-link, page-scrape, robot, crawl, index, spider, offline reader, click spam, macro programs, internet agent, or other automatic device, program, algorithm or methodology which does the same things, to use, access, copy, index, acquire information, generate impressions or clicks, input information, store information, search, generate searches, or monitor any portion of our website or servers for any unauthorized purpose.
  • UCE (Unsolicited Commerce Email) – SPAM Policy: Spamming is the sending of unsolicited e-mail, to persons the sender does not know or have prior consent to send the message to. We have a very strict spam protection policy. This also includes sending unsolicited advertisements to newsgroups, email addresses and/or generating a high volume of outgoing email. There are many ways that someone can hide their identity on the Internet, and we are aware of these ways, so be assured that your account would not be terminated until we are not fully sure that they have indeed abused our services. Sending mails through script should always be less than 500 in an hour, consistent violation of this limit will result in account suspension.
